Renewal postcard reminders for Massage Therapist (MAT) and Massage Establishments (MAE) will be mailed out May 6, 2016

All online renewals will need to be submitted through “MyPVL” at https://pvl.ehawaii.gov/mypvl

To be guaranteed a pocket card by June 30, 2016
Renewals should be submitted by May 31, 2016

Biennial June 30 every even numbered year.

Failure to timely renew by the renewal date will result in the forfeiture of the license. After the renewal date, the forfeited license may be restored within 1 year and subject to meeting restoration requirements. Failure to restore a forfeited license within 1 year after the renewal date will result in the termination of the license and the person must apply as a new applicant and meet current license requirements.

Late renewals/restorationsfor MAT license types with a license expiration date of June 30, 2016 can be submitted online via “MyPVL” at https://pvl.ehawaii.gov/mypvl from July 1, 2016 through midnight (HST), June 30, 2017 and are subject to a late renewal fee.

Late renewals/restorations for MAE license types with a license expiration date of June 30, 2016 must be submitted by hardcopy and are subject to a late renewal fee. Contact the DCCA/PVL to request a restoration application.

Pursuant to Section 436B-14.5, HRS. any license held by a member of the armed forces, National Guard, or a reserve component that expires, is forfeited, or deemed delinquent while the member is on active duty and deployed during a state or national crisis shall be restored if certain restoration requirements are met.     Nursing License Defense

    At the Leichter Law Firm, we may be able to help you understand the following aspects of nursing license defense:

    The Texas Board of Nursing (formerly the Board of Nurse Examiners for the State of Texas) regulates nursing practice in the State of Texas pursuant to the Nursing Practice Act, the Texas Administrative Code and other guiding statutes such as the Health Safety Code and Chapter 53 of the Texas Occupations Code. The Board is charged with regulating RN (Registered Nurse), LVN (Licensed Vocational Nurse), and Advanced Practice Nursing designations such as clinical nurse specialist. They also regulate and grant prescriptive authority to nurses who are credentialed to apply for DEA / DPS prescriptive authority.

    The Board is charged with protecting the public and accordingly it grants, denies, and disciplines nursing licenses / nurse registrations based on what they perceive to be actual or potential violations of the Nursing Practice Act. The Board is comprised of thirteen (13) members, nine (9) of whom are nurses and four (4) who are public members. The Board appoints an Executive Director who is responsible for the day to day affairs of running the agency which are voluminous and include such areas as processing license applications, handling open records requests, promulgating internal rules and procedures, developing policies and procedures on the handling of a variety of matters and running a staff that consists of over one-hundred employees.

    Contrary to popular belief, a nurse undergoing an investigation of his or her license due to alleged practice errors or behavioral transgressions encounters Board Staff and not the Board. The investigators, enforcement team, and Texas Board of Nursing attorneys / lawyers who advise the Board and generate all of the offers of Agreed Orders and policies regarding the same are Board Staff. In fact, a nurse undergoing a disciplinary action / investigation will rarely encounter an actual Board member. Even the Informal Conferences are run and determined by Staff of the Board. Board members will only be encountered if a nursing license applicant is invited to attend a meeting of the Eligibility Disciplinary Committee or if the nurse has gone through the contested case hearing process at the State Office of Administrative Hearings and the matter goes to the Full Board for consideration. Even in these cases the Nurse is rarely afforded an opportunity to appear even though it is well within his / her rights.

    Within the Board’s Staff the disciplinary guidelines and determinations with respect to nursing license discipline are set forward and policed by the Executive Director, the Enforcement Division, the division on Nursing Practice, and the attorneys and lawyers who are employed as Board Staff, but represent the Texas Board of Nursing. Matters of legal representation that go beyond mere discipline and that involve appeals, rule making, declaratory judgments, and administrative writs and law suits in District Court are sent to the Office of the Attorney General. These cases are not tried by the attorneys who are employed by the Texas Board of Nursing as staff lawyers, as they generally involve more complex legal issues that go beyond the expertise and competency level of the Texas Board of Nursing’s Office of the General Counsel. Moreover, due to internal work demands and inherent conflicts of interest these cases are outsourced to the Attorney General.

    The Texas Board of Nursing and Board Staff pride themselves on being a tough and vigorous agency taking the public’s protection charge to heart.     NCBTMB and FSMTB have reached an Agreement. NCBTMB will no longer accept applications to utilize their Licensing exams effective November 1, 2014 for completion February 1, 2015. The MBLEx will be the sole licensing exam for the Massage Profession, this will facilitate portability and standardization for Massage Therapists.

    This act shall be in full force and effect on and after July 1, 2012. Starting July 1st 2013- You must have a valid license to Practice Massage in Idaho.

    Idaho Massage Schools – A list of massage schools in Idaho

    You must complete an approved massage study course of 500 hours and then take and pass the MBLEx. A list of initial licensure and Grandfather clauses for approval until July 1st 2014. The requirements indicate a plan for those already practicing Massage Therapy in Idaho. You must comply with the application process in order to be grandfathered in before July 1, 2014. If you do not obtain a License, you may be subjected to fees of non-compliance and a misdemeanor.

    Beginning in 2012, approved nursing education programs that performed below the minimum standard for NCLEX passage rates for two consecutive calendar years will be placed on probation pursuant to section 464.019(5), Florida Statutes. NCLEX scores for the previous calendar year are released in January of each year.

    A program on probation has one year to meet the minimum standard for NCLEX passage rates. If a program meets the minimum standard, the program will be removed from probation. A program on probation that fails to meet the minimum standard will be terminated by the Board of Nursing.

    Pursuant to Florida law, the Board of Nursing is authorized to extend a program’s probationary status for one (1) additional year if the program demonstrates “adequate progress” towards the “graduate passage rate goal”. Nursing education programs that are placed on probation are required to disclose their probationary status in writing to the program’s students and applicants

    Four forms are now available on the vets.gov site. They are the 22-1990, 22-5490, 22-1995, and 22-1990E. If you select any of those forms within VONAPP, you will be redirected to the vets.gov site.

    The final 2 education forms, the 22-5495 and the 22-1990N will be removed from VONAPP in May. All educations forms will be accessed through vets.gov.

    As of September 20, 2015, you can now apply for Vocational Rehabilitation and Employment (VR E) benefits online through eBenefits. If you were routed here to the Veterans Online Application (VONAPP) page by mistake, please go back to the eBenefits homepage and login.

    Once logged in, on the left hand side of the page:

    – From Dashboard column, go to �Additional Benefits� under Benefits and Payments

    – From the Additional Benefits page expand the VR E link

    – Select apply for either Vocational Rehabilitation and Employment Program or Education/Career Counseling

    To use the eBenefits VR E options, you will need a premium account. If you do not have a premium eBenefits account, please register for one. The register option is located in the top right hand corner on the eBenefits homepage.

    Effective April 6, 2014 � Use VONAPP for Pension claims. If you are a Veteran with an existing VONAPP account, please select I Have Used VONAPP Before. If you do not have an account, please select I Am a New VONAPP User.

    You cannot use VONAPP to submit a Compensation claim. If you want to submit a Compensation claim online, please use the �Apply for Benefits� section on the eBenefits homepage.

    Can I access my incomplete form in VONAPP?

    Partially completed forms and forms saved but not submitted can be accessed in VONAPP for 30 days following the date you started your application. After 30 days, claims not submitted are removed from the system.

    Can I view my completed forms in VONAPP?

    Submitted applications cannot be viewed or printed ; however, you will be able to view and print your submission confirmation page for one year (365 days) from the date of submission.

    Can I start a new VONAPP form?

    VONAPP can be used to prepare and submit new forms for Veterans Pension Benefits, Education Benefits, and Burial Benefits.

    Claims for Compensation Benefits and Dependency Benefits can be filed through VDC. VDC is available for use in eBenefits under the �Apply for Benefits� section. A Premium eBenefits account is necessary for access to VDC. Your VONAPP username and password will not allow access to VDC. To register for an eBenefits Premium account, please visit their DS Logon Account Registration page.

    Once registered, select “Apply” on the eBenefits homepage. You will then be able to select the benefit for which you are wanting to apply.

    The physical therapy consultant serves as a resource to local education agencies, EC directors, physical therapists, physical therapist assistants, parents and students. The consultant is available for on-site, telephone or email consultation for best practice information, resources, program planning and all aspects of school-based physical therapy services.

    What is School Based Physical Therapy (PT)?

    School-based physical therapists work with other professionals to help students with disabilities to benefit from special education. This includes activities of a school day, like: moving throughout school grounds, sitting, standing in line or at the board, moving in class or through the building. All screens, evaluations, consultations, and interventions are performed by physical therapists licensed by the state of North Carolina. Interventions may include adaptations to school environments, working with a student on motor skills, assistance with identifying and getting special equipment, and collaboration with school staff and other professionals.

    All children, who qualify for clinical (or out patient) physical therapy, may not qualify for school-based services. A child’s eligibility for services is determined by a multidisciplinary team that includes parents, educators, program facilitators, the student and other special service providers. The team gathers information about a child’s functional abilities and physical development relevant to their education. This information comes from a variety of sources including parents or caregivers, direct observation, medical and teacher reports, assessment tools, and information or input from community agencies. Recommendations for education based services, including physical therapy, are based upon a thorough review of available information. Findings are shared with team which uses the information and recommendations to develop an Individual Education Program or IEP. If a child qualifies for related services in order to benefit from their special education, they are provided at no cost to families.

    Who Provides School Based Physical Therapy?

    Only physical therapists and physical therapist assistants licensed by the state of North Carolina may provide physical therapy in North Carolina schools.

    Question: On page V of the Directory of Licensees, it states “If the PTA is involved in the plan of care, the patient must be reassessed by the supervising PT no less frequently than every 30-days”. I work in a school system and supervise PTAs that carry out the IEP/PCP. In the school based therapy setting, can that reassessment be in the form of a no less than monthly conversation between the treating PTA and the PT in which they review the IEP goals, the effectiveness of the therapeutic interventions being used, and the need, if any, for a direct visit with the student or any changes. If it is determined that a direct visit is needed, one will then be arranged by the supervising PT to occur either separate from or in conjunction with the time at which the PTA is treating the student. Does this monthly procedure meet the “reassessment” requirement to which you are referring?

    Answer: In the discussion of your question below by the Board, John M. Silverstein (Board Attorney) referred the Board to the following rule:

    SUBCHAPTER 48C-SCOPE OF PHYSICAL THERAPY PRACTICE 21 NCAC 48C.0102 RESPONSIBILITIES
    (j) If a physical therapist assistant or physical therapy aide is involved in the patient care plan, the patient must be reassessed by the supervising physical therapist no less frequently than every 30 days.

    The Board determined that the 30-day rule would be applicable in all settings; therefore, the physical therapist must see and reassess that patient/client not less frequently than every 30-days and that this reassessment may not be defined as a conversation between a PT PTA in which they review the IEP goals, the effectiveness of the therapeutic interventions being used, and the need, if any, for a direct visit with the student.
