What to Do If You’ve Been Fired for Whistleblowing

A whistleblower is an employee who reports a violation of the law by his or her employer. The violation may be against the reporting employee, as with sexual harassment claims, or may be a general violation such as unlawful pollution practices against environmental law.

Remember, you should always check with a whistleblower lawyer in your area to learn about specific whistleblower laws in your particular state.

Whistleblower Protection Laws

There are numerous federal and state whistleblower protection laws that exist to protect both public and private employees who are fired for reporting violations of the law and/or misconduct against their employers. For instance, federal whistleblower protection laws — such as key environment laws including the federal Clean Air Act, Toxic Substance Control Act, The Pollution Prevention Act, and other OSHA Whistleblower Protections — make it unlawful to fire employees in retaliation for filing a claim or reporting violations, including health and safety hazards, and financial misappropriation.

Unlawful to Fire Whisteblowers for Whisteblowing

In addition to federal whistleblower protection laws, most states make it unlawful to fire employees for reporting employer violations and other acts of misconduct. These laws vary, however, with respect to who is protected (whether public employees or private employees) and to whom the protection is afforded (such as co-workers and other business entities). Also, it’s important to note that some state laws require timely filing of whistleblowing claims, such as within 90-days or 120-days. In California, for instance, if you are filing a general whistleblowing claim. you must file it within two years of the alleged retaliatory action.

You may file a complaint with OSHA if your employer retaliates against you by taking unfavorable personnel action because you engaged in protected activity relating to workplace safety and health, commercial motor carrier safety, pipeline safety, air carrier safety, nuclear safety, the environment, asbestos in schools, corporate fraud, SEC rules or regulations, railroad carrier safety or security, or public transportation agency safety or security.

Social Worker Jobs

Social Worker Job Overview

Social workers help individuals of all ages solve problems to improve their well-being and quality of life. They assist families, groups and communities as well. Some social workers also diagnose and treat mental illnesses, emotional problems and behavioral issues. The most common job duties of a social worker may include:

  • Identifying which people may need immediate or long-term help
  • Developing plans to improve the well-being of their clients
  • Evaluating services to see which ones are most effective
  • Responding to emergency situations that may include child abuse or domestic violence
  • Advocating for clients who may be having problems attaining certain resources to improve their health
  • Helping clients communicate with government agencies to get specific benefits that they need
  • Empowering clients by connecting them with community resources like health care
  • Following up with clients to make sure that their lives are improving

These are just a few of the tasks that need to be performed. Candidates who are committed to social justice and helping elevate marginalized individuals out of difficult situations will thrive as a social worker. It is a challenging profession that requires individuals who are able to stay strong and objective while dealing with difficult situations and a wide variety of personalities.

Social Worker Job Education Requirements

Most employers prefer that social workers have at least a bachelor’s of science degree in social work, but some may consider candidates who have bachelor’s degrees in similar fields like sociology or even psychology. Those who are aiming to pursue this profession should try to get a master’s degree in social work because this level of education is needed to work in health care or as a clinical social worker.

Social Worker Job Market

According to the Bureau of Labor Statistics, there is going to be a 19 percent growth in social worker jobs between 2012 and 2022, meaning that over 114,000 new social worker jobs will be created in the coming decade. This profession will see a faster than average growth, but it will vary depending on the social worker’s specialty. The social worker jobs that are in highest demand are those who work asmedical social workers as well as those who work as school social workers .

Social Worker Job Salary Information

The average starting salary for social workers is $44,200 per year. There is, however, a huge variation in salaries among social workers. Ten percent of social workers earn over $70,000 per year, while another ten percent early less than $28,000 each year. Social workers who work in hospitals and schools tend to earn more than those working in social assistance situations or religious organizations.

Michigan Employment Law Attorney: Sexual Harassment, Labor Lawyer, michigan employment attorney.#Michigan #employment #attorney

Michigan Labor & Employment Attorney

Michigan employment attorneyJames C. Curtiss is an attorney with over 35 years of employment law experience, focusing primarily on litigation of claims for sexual harassment, whistleblowers, race, age, gender, and disability discrimination, fringe benefits, nonpayment of commissions, noncompetition clauses, and wrongful termination. I represent both employees and employers. During first several years of my legal career I represented a large automaker headquartered in the Detroit area in most of its major employment trials in southeastern lower Michigan. My present clients come from Wayne, Oakland, and Washtenaw Counties, including Detroit, Canton, Plymouth, Livonia, Northville, Westland, Ypsilanti, Ann Arbor, Belleville, Taylor, Inkster, Dearborn, Dearborn Heights, Redford, and Taylor. I am a partner in the firm of Borda Lorenz, P.C.

Despite longstanding legislation outlawing sexual harassment, it remains a serious problem for many women in the workforce. Many employers frequently attempt to cover up incidents of sexual harassment and ultimately punish the woman who complained. Employers give little recognition to the pain and suffering caused to the victims, who are often forced to choose between the extreme stress of working in a hostile environment or going without an income. A person experiencing sexual harassment needs sound legal advice. Recent court decisions have introduced additional complexities and legal barriers to the successful pursuit of sexual harassment claims. Without an attorney knowledgeable about the law and familiar with the dynamics of how employers deal with sexual harassment, a victim of sexual harassment is likely to have little success in achieving a just outcome.

I handle not only sexual harassment matters, but nearly every other type of employment law issue including employment discrimination, fringe benefits, whistleblowers and other wrongful termination claims, noncompetition clauses, employment contracts, Family and Medical Leave Act, and severance packages. I pursue most employee claims on a contingent fee basis, where any attorney fee is paid out of the recovery. With my first-hand knowledge of how employers deal with employment-related legal issues, I can bring a unique perspective to dealing with your claim. I am a small firm and very selective with my cases, so you will not have to fight through an army of secretaries, law clerks, legal assistants, and junior lawyers to get to me.

I have obtained favorable results for many clients, including settlements ranging into the hundreds of thousands. Since I offer free email or telephone consultations, I invite you to contact me.

Employment and Salary Trends for Virginia Photographers

Virginia is home to 1,120 salaried photographers averaging $32,500 per year, down from $41,020 in 2009, when the state was home to 1,220 photographers. It is important to note that many professionals in this field are self-employed, so it is safe to assume that the population of photographers in the state is much higher. These individuals typically earn more and enjoy greater employment growth as well. In fact, according to the Bureau of Labor Statistics (BLS), the “Independent Artists, Writers, and Performers” ‘industry’ has the third highest concentration of employment for photographers and they earn an average of $47,180 per year.

Nationwide, the median pay for photographers is $30,490 per year. Employment for photographers is projected to grow three percent for the 2014-2024 decade, which is slower than the average for all occupations. At this rate, the industry is expected to add around 3,900 new jobs in the coming years. Overall growth will be limited because of the decreasing cost of digital cameras and the increasing number of amateur photographers and hobbyists, says the Bureau.

In addition, stock photographic services available online give individuals and businesses access to stock photographs for a fee or subscription, possibly dampening demand for photographers. Declines in the newspaper industry will reduce demand for news photographers to provide still images for print, says the Bureau. Employment of photographers in newspaper publishing is projected to decline a staggering 41 percent for the 2014-2024 decade, according to the BLS.

However, employment of self-employed photographers is projected to grow nine percent for the 2014-2024 decade. Projected growth, says the BLS, will be due to the demand for portrait photographers, which will persist as people continue to want new portraits. In addition, corporations will continue to require the services of commercial photographers to develop compelling advertisements to sell products.

The top paying states for photographers are:

  • District of Columbia ($66,410)
  • New York ($54,030)
  • California ($52,750)
  • Hawaii ($47,740)
  • New Mexico ($46,220)

The top paying industries for photographers are:

  • Aerospace Product and Parts Manufacturing ($76,090)
  • Medical and Diagnostic Laboratories ($69,230)
  • Motion Picture and Video Industries ($67,160)
  • Scientific Research and Development ($63,530)
  • Other Information Services ($61,090)

The industries with the highest levels of employment for photographers are:

  • Other Professional, Scientific, and Technical Services
  • Radio and Television Broadcasting
  • Newspaper, Periodical, Book, and Directory Publishers
  • Motion Picture and Video Industries
  • Other Personal Services

The Industries with the highest concentration of employment for photographers are:

  • Other Professional, Scientific, and Technical Services
  • Radio and Television Broadcasting
  • Independent Artists, Writers, and Performers
  • Newspaper, Periodical, Book, and Directory Publishers
  • Scenic and Sightseeing Transportation, Water

The states with the highest employment levels for photographers are California, New York, Florida, Texas, and Illinois.

While employment growth for photographers is projected to be slower than average overall, Virginia-based photographers can do a few things to increase their chances of finding employment. Consider checking into portrait studios, local publications, technology firms, schools, creative agencies, and design studios. And stick to major cities such as Virginia Beach—the state’s largest, Norfolk, Chesapeake, Arlington, and Richmond. Also worth exploring are Newport News, Alexandria, Hampton, Roanoke, and Portsmouth.

Awesome Animation Fact. Hayao Miyazaki wrote, directed, and drew the storyboards for his the Academy Award winning film for Best Animated Feature—Spirited Away (2001). So, Miyazaki essentially wrote the movie with drawings. When you watch the film, you’re seeing one man’s work and vision. The filmmaker is so influential and involved in the production that the New Yorker once called him “the auteur of anime.” –mental_floss
