Penn State hazing case: ‘Excruciatingly difficult’ for victim’s family to hear details in court

It is “excruciatingly difficult” for the family of Penn State pledge Timothy Piazza, who died after a fall at a fraternity house earlier this year, to sit in court, listening to the alleged details of fraternity members’ actions after their son was hurt, said the Piazza family attorney.

“In Jim Piazza’s words, ‘There wasn’t a moment today that I couldn’t stop thinking about my son Tim,'” Tom Kline, attorney for the Piazza family, told ABC News on Monday. “It is excruciatingly difficult for the Piazzas to sit and listen to the callous and reckless misconduct of individuals who cost them their son and cost their son his life.

But they are determined steadfastly and resolutely to go through with this process so that justice is done.”

Piazza, a 19-year-old sophomore and pledge at Beta Theta Pi, died on Feb. 4 after he fell down the stairs during a night of drinking for a pledge ceremony at the house on the night of Feb. 2. In text messages, fraternity members refer to the pledge ceremony drinking as an “obstacle course.” Fraternity members did not call 911 until the morning of Feb. 3, about 12 hours after Piazza’s fall, according to a report on the grand jury’s investigation. Piazza’s death “was the direct result of traumatic brain injuries,” according to the forensic pathologist.

Tim Piazza, a 19-year-old Penn State sophomore and pledge at Beta Theta Pi, died on Feb. 4, 2017 after he fell down the stairs during a pledge ceremony at the house on the night of Feb. 2.

Prosecutors claim the former fraternity brothers at Beta Theta Pi waited to get Piazza help in an attempt to cover up their drinking and “coordinate a story.”

Eighteen Penn State students are facing charges: eight for involuntary manslaughter, aggravated assault, reckless endangerment, and hazing, among other charges; four for reckless endangerment and hazing, among other charges; and six for evidence tampering. The Beta Theta Pi fraternity — which has since been barred from Penn State — is facing charges including involuntary manslaughter and hazing. No defendants have entered pleas at this time.

At a preliminary hearing, which began in June and continued Monday and today, prosecutors revealed texts and internet searches allegedly sent and made by some at the fraternity house. After the hearing, a judge will decide if there is enough evidence to go to trial.

One brother allegedly texted his girlfriend “drink hazing can send me to jail,” and “I don’t want to go to jail for this.”

“I think we are f—–,” the ex-fraternity brother allegedly said.

Someone allegedly texted, “When they see the video footage of the obstacle course we will be done.”

One then-fraternity member allegedly asked, “What times did they take tape of?” and another member replied, “Nah, they took tapes from 7 to 9:30am.”

“F— yes,” the first fraternity brother responded. “We should be good,” the second fraternity brother said.

After Piazza’s injury, one of the fraternity members allegedly texted another, “Make sure the pledges clean the basement and get rid of any evidence of alcohol.”

Another text said, “Make sure the pledges keep quiet about last night and this situation.”

Prosecutors also said one of the young men did an internet search for: “How would 9 drinks in an hour affect a 200 pound guy.”

Frank Fina, an attorney for the former fraternity president, on Monday questioned a detective who said it is unclear how much alcohol Piazza had during the “obstacle course” hazing ritual as opposed to the separate party in the basement.

Fina asked if it’s fair to say the pledges could have left at any time, and the detective said yes.

Fina asked the detective if anyone physically threatened any pledges to drink, or if anyone threatened to harm pledges, and the detective said not that he was aware of.

Kline, however, told ABC News, “The concept that this was quote ‘voluntary drinking’ conjures up a social event where people all gather together and have a cup of wine — this was forced alcohol poisoning.”

“This was an individual among other individuals who were told you cannot get into this organization unless you do certain things, and here’s what you must do,” Kline said. “So there is under the law of Pennsylvania, as in most states, a forcible compulsion. A forcible act against another human being.”

Fina also said in court Monday that two Penn State-hired “social checkers,” provided by private security company St. Moritz Security for the Infrafraternity Council, attended the fraternity party that night. Prosecutors have suggested that fraternity members somewhat cleaned up before the social checkers’ arrival. The detective testified there was no evidence showing that anything was cleaned up, citing alcohol boxes in the lobby when the security guards walked in.

The detective said the social checkers went to the party nine minutes before Piazza’s fall, and were inside the house for two to three minutes. The detective said it’s probable that Piazza and the social checkers were in the basement at the same time, when Piazza was visibly very drunk. Video reportedly shows the social checkers leaving the party shortly before the fall.

The detective on the stand admitted that the social checkers were not interviewed and the detective said he does not know if the social checkers filed any complaint. St. Moritz Security declined to comment.

Rocco Cipparone, an attorney for one of the former fraternity members charged, told ABC News Monday that the security guards are trained and “know what they are looking for. And if they don’t see a problem,” a college student, like his client, should not be expected to see a problem.

“It’s a horrible tragedy. My client’s empathies go out to the Piazza family, so do mine. But it was not a crime, at least as to” his client, Cipparone said. “These are young men. probably none of them had the intention, of course, to harm Timothy Piazza, and they’re trying to figure it out. Hindsight is 20/20. We’re looking at a video with the hindsight of knowing, sadly, Mr. Piazza died. But the defendants were not knowing that when they’re observing the situation. These are normal 19, 20, 21-year-old guys who are just experiencing something live — not in the hindsight we are looking at it in this courtroom.”

Ted Simon, an attorney for another former fraternity member charged, on Monday called Piazza’s death an “awful, awful tragedy,” adding, “but not every tragedy. should result in a criminal prosecution.”

Simon said, with his client, “the charges are really unfounded, unwarranted and unjustified. I fully expect in the end that will be clearly demonstrated.”

But Kline said, “There are individuals who actually plotted this alcohol poisoning. There are individuals who failed to assist Tim Piazza, there are people who looked the other way and there are people that covered it up. While there is crossover among some of them who planned, executed, and covered up the events that led to Tim Piazza’s death – each and every one of them individually bears some responsibility.”

Penn State has announced proposals for new safety reforms, including: having university staff members monitor social events; the university taking control of the fraternity and sorority misconduct and adjudication process; and permanent revocation of university recognition for any chapter involved in “hazing that involves alcohol, physical abuse, or any behavior that puts a student’s mental or physical health at risk.”

Penn State President Eric Barron said, “There are other measures being discussed and will be instituted over time — all with a focus on prevention, monitoring and enforcement. These measures augment a series of actions taken earlier this year, which are being made permanent.”

Barron added, “I am resolved to turn the pain and anguish radiating through our entire community into decisive action and reform, concentrating on the safety and well-being of students at Penn State.”

Penn State’s Interfraternity Council said, “We agree that added social restrictions, education, transparency and professional staff support are critical. We have tried to remain committed to being an active part of the solution within our community. We stand firm on our belief that when students are involved in collaborating with the university in monitoring and accountability, a greater impact is made. For that reason, we will continue to push for a partnership between student leaders and the university.”

Drivers there pay 136 percent – more than double – the national average, according to data from insuranceQuotes.com. North Carolina drivers get the best deal, paying 41 percent less than the national average.

20 years later, winning OJ civil suit was never a pot of gold

On the morning of June 12, 1994, O.J. Simpson was worth an estimated $11 million.

Within hours, he would stop earning and start spending.

Simpson was arrested in the killings of his ex-wife, Nicole Brown Simpson, and Ron Goldman, a waiter from the restaurant where she dined shortly before her death. Simpson, a popular ex-athlete and actor, was acquitted in a criminal trial.

The Goldman and Brown families then sued him in civil court, and that jury unanimously found Simpson liable for the murders. He was ordered to pay a total of $33.5 million, made up of $8.5 million in compensatory damages to the Goldmans and $25 million in punitive damages to be split between the Goldmans and Nicole’s children.

“The dollar amount meant nothing to us,” Kim Goldman told CNBC. “We were just thrilled that 12 people unanimously determined that he was the killer of Ron and Nicole. The rest was just paper.”

Still, the Goldmans pursued Simpson’s assets. “The only punishment that could be meted out was financial,” said Daniel Petrocelli, who represented the family in the civil trial. But did Simpson have any money left? “He claimed to be broke.”

Kim Goldman soon learned that winning the multimillion-dollar award was one thing, collecting it was another. “People assume that when we were awarded our civil judgment, that with that judgment we were handed a pot of gold, and that’s just the furthest thing from the truth,” she said.

Simpson’s attorneys argued during the damages phase of the civil trial that he was approximately $850,000 in debt. Attorneys for the victims’ families argued the ex-athlete had already made about $2.8 million since his acquittal selling rights to a book, video, autographs and other memorabilia. Petrocelli believed Simpson could earn even more in the years to come, “given that he is probably the most famous man ever found to have killed two people in this way.”

Under California law, someone who loses in a civil trial but wants to hold off paying a judgment during appeal needs to post a bond worth 150 percent of the judgment. “[Simpson] said he didn’t have it, he didn’t put up the bond,” Petrocelli said. So the Goldmans immediately sought whatever assets they could find. Among them was O.J. Simpson’s Heisman Trophy, which sold at auction for $500,000. “Most of that money went to pay some expenses for the case,” Petrocelli said. “By the way, the lawyers for the victims’ families did not get paid for this case.”

Petrocelli and the Goldmans believe Simpson continued to make money “underground,” selling autographs and memorabilia for cash. They could not, by law, touch his $25,000 a month pension from the NFL, and his home on Rockingham was of little value because so many loans had been taken out against it to pay legal fees.

Kim Goldman believed there was money somewhere. “The killer worked really hard to hide all of his assets, and so we were always coming up against some kind of a wall,” she said. Her family’s share of the award, with interest, is now close to $40 million. “We’ve collected less than one percent of that.”

Most of that came when the Goldmans discovered in 2006 that O.J. Simpson had received a sizeable advance for a book called, “If I Did It.” At first, they tried to have the book quashed, but when the rights to it were to be auctioned off in bankruptcy court, Kim Goldman said they purchased those rights to avoid Simpson somehow secretly profiting. She said the court ordered her family to publish the book.

“People were very angry at us for publishing that book, because they didn’t understand how we ended up with it,” she said. As for criticism that her family is “in it for the money,” she paused before replying. “I understand from a logical point of view that people think that all my dad and I are out to do is to capitalize on Ron’s murder. However, we followed the law. The criminal system failed us, so we went after him civilly. it’s punishment, it’s retribution, it’s what our system afforded to our family.”

Petrocelli agrees. “The Goldmans want to obtain Simpson’s assets because they don’t want him to live a good life. He killed their son. He murdered their son.”

The family finds some consolation in knowing that Simpson is now serving time in prison for robbery and kidnapping in a Las Vegas hotel room in 2007. O.J. Simpson said he went to that room to reclaim stolen belongings. However, the belongings he hoped to retrieve, including the suit he wore when he was found not guilty, are exactly the type of assets that could have been sold, with proceeds going toward his judgment.

Kim Goldman believes it was Simpson’s own efforts to hide assets that ultimately led to his incarceration. “Irony is amazing,” she said.

As for O.J. Simpson’s current net worth, his lawyer, Patricia Palm, told CNBC she did not know how much money he has. When asked if he is able to pay her, she would not comment, citing attorney-client privilege. Simpson’s home in Florida went into foreclosure, though he is still presumably getting his NFL pension.

He could be paroled in three years, and it’s possible Simpson would try again to make a living. “We’ll be there waiting and watching,” said Kim Goldman. “I’m not letting up. If I did, then I’m telling him it’s okay for what he did.”

Quartz, a business and marketing website, recently released data on the Facebook dating app Are You Interested. which connects single people with others within the confines of their Facebook networks. Quartz’ data are based on a series of yes-or-no questions about who users are interested in, as well as response rates between users, once notified of a potential suitor. The data show that white men and Asian women receive the most interest, whereas black men and women receive the least amount of interest. The writers at Quartz summarize the findings as follows:

Unfortunately the data reveal winners and losers. All men except Asians preferred Asian women, while all except black women preferred white men. And both black men and black women got the lowest response rates for their respective genders.

As a sociologist, I am entirely unsurprised that race matters, especially in such a personal process like dating/mating. However, these findings may come as a surprise to the (quite significant) segments of the population who identify as color-blind; those who label contemporary society post-racial.

And this is why dating sites are so cool. Social psychologists know that what people say and what they do have little empirical connection. Dating sites capture what we do, and play it back for us. They expose who we are, who we want, and of course, who we don’t want. As shown by Quartz, “we” fetishize Asian women while devaluing blacks.

With a schism between what people say and what they do; between what they say and what the unconsciously think, surveys of racial attitudes are always already quite limited. People can say whatever they want — that race doesn’t matter, that they don’t see color — but when it comes to selecting a partner, and the selection criteria are formalized through profiles and response decisions, we, as individuals and a society, can no longer hide from ourselves. The numbers blare back at us, forcing us to prosume uncomfortable cultural and identity meanings both personally and collectively.

Indeed, before anyone has answered anything, the architecture of online dating sites say a lot. Namely, by defining what can be preferences at all, they tell us which characteristics are the ones about which we are likely to care; about which we should care.

Both the user data and the presence of racial identification and preference in the first place are revealing, demolishing arguments about colorblindness and post-racial culture.

Overview

Bachelor of Science

The Computer Information Systems major consists of core courses in applied programming, networking, and database design followed by an in-depth career-focused track. Many graduates of this program continue their education by pursuing a master’s degree in business and technology management or forensic studies.

In 2014, our program became one of only six undergraduate programs, in the nation, to earn “The National Centers of Digital Forensics Academic Excellence ” accreditation by Defense Cyber Crime Center (CD3.)

Tracks

Computer Forensics Track

Upon completion of the computer forensics track, graduates will be able to:

  • Analyze and manipulate complex network infrastructures.
  • Design and implement a network security plan.
  • Construct an incident response team.
  • Evaluate an end-to-end computer forensics investigation.
  • Carry out evidence collection according to established protocols.
  • Assemble testimonial evidence to act as an expert witness at a trial.

Network Design Track

Upon completion of the network design track, graduates will be able to:

  • Assess business problems and implement the best network solution.
  • Apply knowledge of operating systems to construct various networking environments.
  • Design messaging systems for problem reporting and resolution.
  • Formulate secure network infrastructures in efficient topologies.
  • Implement integrated voice and data services.

Software Design Track

Upon completion of the software design track, graduates will be able to:

  • Assess business problems and select and implement the best programming language environment.
  • Formulate software solutions for the desktop computing platform.
  • Design software solutions for the Internet.
  • Integrate database solutions with web and desktop applications.
  • Develop software solutions for wireless handheld devices.

Minor

The minor in information systems requires successful completion of a minimum of six courses and 18 credits with an IS prefix. All course prerequisites must be met to be eligible to take the selected course for a minor. Please see an academic advisor for more information. BS/MS Option

The BS/MS option is available for students majoring in Computer Information Systems who wish to combine their bachelor’s coursework with work toward a master’s degree in one of Stevenson’s graduate programs. Students choosing this option may earn their master’s degree in as little as one year after their bachelor’s degree. Interested students must formally apply for entrance into a BS/MS option in their junior year. Once admitted into this program, students develop an educational plan in consultation with their undergraduate and graduate advisors.
